Automatic Dismissal

Failure to File All Information*

If an individual debtor in a ch. 7 or 13 voluntary case fails to file all of the information required under § 521(a)(1) within 45 days of the date of filing of the petition, the case shall be automatically dismissed effective on the 46th day after the date of filing. Any party in interest may request the court to enter a dismissal order, and the court must enter such order not later than 5 days after such request. However, within the first 45 days, the debtor may request an additional period of time (up to 45 days) to file the information required under § 521(a)(1).

* Please note that the 15 day day deadline as required by Rule 1007(b) & (c) still applies.  Failure to cure deficiencies within 15 days results in the normal 20 day Notice of Dismissal.
