Despite our continued effort to raise this issue in our newsletters and our attorney forums, we continue to have a large number of overpayments in chapter 13 cases where the filing fee is going to be paid through the plan. Processing these overpayments is labor intensive. In a further attempt to prevent these from happening, our judges have signed a new administrative order emphasizing the necessary steps to help avoid these overpayments. The order also requires a show-cause hearing to be set when an overpayment occurs.
