In City of Jacksonville v. Jacksonville Hospitality Holdings, L.P., et al, the Eleventh Circuit held that voluntary dismissals under Federal Rule of Civil Procedure 41(a)(1)(A)(ii) require all parties who have appeared in a case to sign a joint stipulation of dismissal, even if they are not the party being dismissed or have already been dismissed from the case.
Please keep this rule change in mind as you prepare any requests for dismissals under FRBP 7041(a)(1)(A)(ii).
