New Federal Rules of Bankruptcy Procedure and Forms, December 1, 2023

On December 1, 2023, several new or amended Federal Rules of Bankruptcy Procedure go into effect. There are also two form changes.

- Rule 3011 now requires the Clerk of Court to post a link to searchable information on unclaimed funds. This is already on our website at this link.
- Rule 8003 is updated to prevent the loss of appellate rights in certain circumstances.  Official Form 417 is modified to conform to the change.
- Rule 9038 is new and allows the Judicial Conference to declare a "rules emergency" in the event the President declares a national emergency.
- Rule 9006(a)(6)(A) adds Juneteenth as a recognized court holiday.
- Official Form 410A is modified to break out lines for principle and interest instead of a combined field.

The new and modified Rules can be found here.  The new Official Forms 417 and 410A will be available on the U.S. Courts website on the effective date.
